After conviction by the Berlin district court – before the constitutional court for climate justice

Berlin, June 18.01.2023, 14, 35:XNUMX a.m – The trial against the 21-year-old Berlin medical student took place today in the Berlin district court John O. instead of. After he took part in a Last Generation road blockade, the local court last year imposed a fine of €600, which he appealed against. The regional court confirmed the district court's judgment today. Johann will lodge a constitutional complaint against the conviction. 

Since Johann is still an adolescent before the law, the next step is to file a constitutional complaint.

For Johann is certain: “The government is acting criminally. It is knowingly breaking the Paris Agreement and maneuvering us into a catastrophe from which there is no escape. The fact that I and so many others who point out this political failure are being criminalized is absurd and unacceptable.”

He further explains: “The regional court decided to punish me for my protest against the government’s violation of the constitution. I cannot and will not simply accept that. Now we are giving the Federal Constitutional Court the opportunity to determine that disruptive protests are appropriate in the face of the climate emergency.”

We are already having to mourn thousands of deaths from heat in Europe. One drought follows another all over the world, causing countless people to starve, die of thirst or sink into hopeless poverty. The suffering caused by the climate catastrophe is already beyond imagination.

Wolfgang Lucht, renowned German physicist and geography professor in the field of climate research and chair of the Earth System Analysis Department at the Potsdam Institute for Climate Impact Research wanted to testify in court today as an expert. He planned to explain why it is necessary to stop the federal government's deadly course. The court rejected this, saying what he could testify was not fact.

Carla Rochel, speaker of the Last Generation, is indignant: “The court is turning a blind eye to the crisis and does not want to recognize the dramatic nature of the climate catastrophe, let alone take it into account in its deliberations. It is clearly shirking its responsibility.”

She resolutely adds: “The next step for us is the constitutional complaint. It is then the Federal Constitutional Court's turn and must decide what means we as a society still have to fight for our survival. We are giving him the opportunity to continue his jurisprudence from the 2021 climate ruling.”
